The Indiana Court of Appeals reviewed the 12(B)(8) requirement that a second case be dismissed where the parties, subject matter, and remedies are the same or substantially the same as those in an already pending action. The Court then applied the facts of Vannatta v. Chandler to each requirement illustrating what is needed for the second action to survive a 12(B)(8) motion
